The Regional District of Okanagan-Similkameen is applying for a licence of occupation over former Kettle Valley Railway properties between Osprey Lake and Summerland, in order to maintain tenure over the trail.
The tenure allows the regional district to maintain the former railway as a trail in the area.

The former railway is part of the Trans-Canada Trail. In 2011, the regional district signed a 15-year partnership agreement with the Recreations Sites and Trails B.C. for the operations and maintenance of the trail within the regional district, excluding municipal areas and the Penticton Indian Band lands.
The partnership agreement defines the roles and responsibilities for trail maintenance. Justin Shuttleworth, parks and facilities manager with the regional district, said the partnership agreement was an effective interim measure, but the licence of occupation will provide the legal tenure necessary for the work.
